AU Designs Search System - Past Notices

ADDS Enhancements. The ADDS Converted Designs are now hosted on their own
page that can be accessed by clicking on the "Designs Act 2003 Converted Designs" quick link on the main page. Quick Links have also
been updated to valid pages including those on the Classification Code page. Other changes to the ADDS system include displaying current Designs Act 2003
records in the Quick Guide, change of wording from 'In Force to' to 'Renewed to' to clearly state when the Designs renewal is due and
rectifying errors for Firefox users when using the Advanced Search function.

The New Designs Act (2003) commenced on Thursday 17th June. All
proceedings as of the 17 June 2004 will be under the Designs Act 2003 and the
transitional provisions relating to actions under the Designs Act 1906.
The ADDS system will continue to include data relating to applications and registrations
under the provisions of the old 1906 Act, including transitional processes, as well data
relating to applications and registrations under the new 2003 Act.

The New Designs Act (2003) commenced on Thursday 17th June. All
proceedings as of the 17 June 2004 will be under the Designs Act 2003 and the
transitional provisions relating to actions under the Designs Act 1906.
The ADDS system will continue to include data relating to applications and registrations
under the provisions of the old 1906 Act, including transitional processes, as well data
relating to applications and registrations under the new 2003 Act.
Several minor changes have been made to the structure and function of the ADDS system
to cater for the provisions of the new 2003 Act.
Some of the key features of the New Designs Act (2003) are:
- An applicant may request either Registration or Publication.
- The maximum Registration term is 10 years, renewal at 5 years.
- Substantive examination can only occur after registration and only upon request.
- Examination can be requested by a third party.
- The criteria for novelty have been defined as "New and Distinctive"
- An applicant can choose to convert a pending transitional application to an application
under the new act

New Edition of IDC There have been some changes made in
the IDC 8th edition from IDC 7th edition. The original classification made
on design applications lodged prior to 01.01.2004 have been retained. All
new design Applications from 01.01.2004 will be classified according to
IDC8. Some classifications may be needed to be searched in both versions.
Notations are shown in italics in the sub-class sheets where the changes
have been made. A list of the changes are shown in the summary page.

NOTICES PRIOR TO 1 JULY 2001

ADDS DATA LOADING ERRORS:
Discrepancies have been found for search results using the search fields
"lodgement captured", "status changes", "other changes", "official notice
changes" and/or "all changes" for the dates 11 August (2000.08.11) and 8
December 2000 (2000.12.08). The data has since been correctly downloaded,
updating all the data and data change dates existing on their history
records. Please note, these dates do reflect the data change dates as if
they had initially been downloaded successfully. We recommend repeating
any searches containing the above search fields and covering the above
dates. |

ADDS DATA RELOAD: ADDS allows
you to update an earlier search without you having to reconsider the
search results that you have previously seen. If you use this facility,
you need to be aware that all ADDS data was fully reloaded on 23rd June
2000 to correct errors in the "In Force Date" of some additional (Section
25D) design registrations and to correct minor data inconsistencies.
Earlier searches that you repeat after 23rd June will, as a "once
off", have to be reconsidered in full in the first only repeat
search. |

ADDS TEXT SEARCH ERROR: On 7
April 2000, ADDS was changed to simplify text searching by ignoring the
"apostrophe" character. Unfortunately, this change inadvertently resulted
in text searching in the ADDS Advanced Search not working for any search
words or text strings containing the character "Y" or "y". ADDS Advanced
Searches of text strings containing "Y" or "y" on data fields "Name",
"Article/Product", "Agent/Attorney" and "Convention Country" conducted
between April 7 and June 23 will not have given correct search results and
will need to be redone. We apologise for the inconvenience and
difficulties caused by the data reload and the above errors. If you have
